Terms of Use

1. Eligibility

You must be at least 13 years old to use the Service.

By using Diarya, you represent and warrant that you meet this requirement.

2. Accounts

To access certain features, users must create an account.

You are responsible for maintaining the confidentiality of your account, all activity under your account, and providing accurate information.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscription and Billing

Diarya may offer free and paid subscription plans.

Subscriptions may renew automatically, be billed monthly or yearly, and be managed through Apple or RevenueCat-supported payment systems.

Users are responsible for managing or canceling subscriptions through their platform account settings.

Refund requests may be reviewed on a case-by-case basis and may also be subject to platform-specific policies.

4. User Content

Users retain ownership of the content they create, including journal entries, voice recordings and transcriptions, AI-generated images, and other personal content.

By using the Service, you grant Guchly Studio a limited license to process and store content solely for the purpose of operating and improving the Service.

Users are responsible for the legality and appropriateness of content they create or upload.

5. Prohibited Conduct

Users may not upload illegal content, share sexually explicit or NSFW material, harass or threaten others, engage in hate speech or abusive behavior, infringe intellectual property rights, send spam or malicious content, attempt reverse engineering, scrape or automate access to the Service, abuse AI systems, impersonate individuals or organizations, or interfere with the security or operation of the Service.

Violation of these rules may result in suspension or permanent account termination.

6. AI Features and Disclaimer

Diarya includes AI-powered tools and generated outputs.

AI-generated content may contain inaccuracies, inconsistencies, or unintended results.

Users are solely responsible for reviewing and using generated content.

Diarya is not a medical, psychological, therapeutic, or crisis-support service. Nothing generated by the Service should be considered medical, legal, or professional advice.

7. Intellectual Property

The Diarya application, branding, software, design, and related intellectual property are owned by Guchly Studio.

Except where explicitly permitted, users may not copy, modify, distribute, sell, or exploit any part of the Service.

Users retain ownership of their own generated and uploaded content.

8. Availability

We may modify, suspend, or discontinue parts of the Service at any time without liability.

We do not guarantee uninterrupted availability or error-free operation.

9. Limitation of Liability

To the maximum extent permitted by law, Guchly Studio shall not be liable for indirect or consequential damages, loss of data, loss of profits, service interruptions, AI-generated inaccuracies, or unauthorized access to accounts.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

10. Termination

We may suspend or terminate access to the Service at any time if users violate these Terms or misuse the platform.

Users may stop using the Service and delete their accounts at any time.

11. Governing Law

These Terms shall be governed by and interpreted under the laws of Türkiye.

Any disputes arising from these Terms or use of the Service shall be subject to the jurisdiction of the competent courts of Türkiye.

12. Changes to These Terms

We may update these Terms from time to time.

Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
